As sharing and secondary research use of biospecimens increases, IRBs and researchers face the challenge of protecting and respecting donors without comprehensive regulations addressing the human subject protection issues posed by biobanking. Variation in IRB biobanking policies about these issues has not been well documented.

We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. I have three aims in this essay. I want to offer an example of an interdisciplinary historical inquiry combining literary criticism with the relatively new field of critical legal studies. I intend to use this historical inquiry to argue that the ambiguity of literary texts might better be understood in terms of an era’s social contradictions rather than in terms of the inherent qualities of literary language or rhetoric and, conversely, that a text’s ambiguity can help us expose the contradictions (...) masked by an era’s dominant ideology. I try to prove my assertion by applying my method to Herman Melville’s three most famous short works—“Benito Cereno,” “Bartleby, the Scrivener,” and Bill Budd, Sailor—works dealing with the law and lawyers and widely acknowledged as ambiguous.1 I will base my critical inquiry into these stories on Melville’s relationship with his father-in-law, Lemuel Shaw, who, while sitting as the chief justice of the Supreme Judicial Court of Massachusetts from 1830 to 1860, wrote some of the most important opinions in what Roscoe Pound has called “the formative era of American law.”2Before I get started, I should clarify what this study does not entail. By using Shaw and his legal decisions in conjunction with Melville’s fiction, I am not conducting a positivistic influence study. My method will not depend on the positivist assumption that Shaw’s legal opinions can be used to illuminate Melville’s texts only when his direct knowledge of Shaw’s opinions can be proved. Nor will I limit myself to a traditional psychoanalytic reading: my emphasis is on political and social issues, and too often these issues are deflected by translating them into psychological ones. At the same time, I recognize that critics concerned with political and social issues too often neglect questions raised by a writer’s individual situation. I compare Shaw to Melville not to reduce Melville’s politics to psychology but to prevent a political study from neglecting the political implications of psychology, to remind us—as the title of Fredric Jameson’s book The Political Unconscious reminds us—that psychological questions always have political implications. 1. Many of the papers in this volume originated in a colloquium at the University of Western Ontario in 1967. These include a paper on the logic of norms by G. H. Von Wright, a paper on the logic of questions by L. Åqvist, a paper on the logic of belief by W. Sellars, and a paper on inductive logic by R. Ackermann. The commentaries by Anderson and Sosa have been revised for the volume and a further commentary to Ackermann's (...) paper by Wesley Salmon has been added. In addition to the colloquium papers a number of further papers are published here for the first time: J. Hintikka on the semantics of propositional attitudes, R. Hilpinen on relativized modalities, C. Harrison on the unanticipated examiner and H. Smokler and M. Rohr on confirmation and translation. The volume is completed by two papers published in Synthese and a well-known paper in modal logic by Lemmon, Meredith, Meredith, Prior, and Thomas published complete with a new postscript by Prior. Although the collection is somewhat haphazard and seems to have no unifying theme, philosophers interested in these topics in philosophical logic will be thankful for the availability of the papers, both old and new.--R. One of the central, abiding, and unresolved questions in environmental ethics has focused on the criterion for moral considerability or practical respect. In this essay, I call that question itself into question and argue that the search for this criterion should be abandoned because (1) it presupposes the ethical legitimacy of the Western project of planetary domination, (2) the philosophical methods that are andshould be used to address the question properly involve giving consideration in a root sense to everything, (3) (...) the history of the question suggests that it must be kept open, and (4) our deontic experience, the original source of ethical obligations, requires approaching all others, of all sorts, with a mindfulness that is clean of any a priori criterion of respect and positive value. The good work that has been doneon the question should be reconceived as having established rules for the normal, daily consideration of various kinds of others. Giving consideration in the root sense should be separated from giving high regard or positive value to what is considered. Overall, in this essay I argue that universal consideration—giving attention to others of all sorts, with the goal of ascertaining what, if any, direct ethical obligations arise from relating with them—should be adopted as one of the central constitutive principles of practical reasonableness. Friedrich Nietzsche was immensely influential and, counter to most expectations, also very well read. An essential new reference tool for those interested in his thinking, Nietzsche’s Philosophical Context identifies the chronology and huge range of philosophical books that engaged him. Rigorously examining the scope of this reading, Thomas H. Brobjer consulted over two thousand volumes in Nietzsche’s personal library, as well as his book bills, library records, journals, letters, and publications. This meticulous investigation also considers many of the annotations (...) in his books. In arguing that Nietzsche’s reading often constituted the starting point for, or counterpoint to, much of his own thinking and writing, Brobjer’s study provides scholars with fresh insight into how Nietzsche worked and thought; to which questions and thinkers he responded; and by which of them he was influenced. The current essay introduces the guidance theory of representation, according to which the content and intentionality of representations can be accounted for in terms of the way they provide guidance for action. The guidance theory offers a way of fixing representational content that gives the causal and evolutionary history of the subject only an indirect role, and an account of representational error, based on failure of action, that does not rely on any such notions as proper functions, ideal conditions, or (...) normal circumstances. Moreover, because the notion of error is defined in terms of failure of action, the guidance theory meets the “meta-epistemological requirement” that representational error should be potentially detectable by the representing system itself. In this essay, we offer a brief account of the biological origins of representation, a formal characterization of the guidance theory, some examples of its use, and show how the guidance theory handles some traditional problem cases for representation: the representation of fictional and abstract entities. Being both representational and actiongrounded, the guidance theory may provide some common ground between embodied and cognitivist approaches to the study of the mind. (shrink)

The public interest statement contained in the PRSA Code of Professional Standards is unduly vague and provides neither a working definition of public interest nor any guidance for the performance of what most professions consider to be a primary value. This paper addresses the question of what might constitute public relations service in the public interest, and calls for more stringent guidelines to be developed whereby the profession may advance its service goals more clearly.

The current status of Beilock and Carr's "execution focus" theory of choking under pressure in performance of a sensorimotor skill is reviewed and assessed, mainly from the perspective of cognitive psychology, and put into the context of a wider range of issues, attempting to take philosophical analysis into account. These issues include other kinds of skills, pre-performance practice, post-performance evaluation and repair, and integrating new and creative achievements into repertoires of heavily practiced routines. The focus is on variation in the (...) demand for reflection versus automaticity across the full gamut of learning and experience, not just game-time performance. Though automaticity remains important and there are many circumstances in which being "in the zone" is good whereas “execution focus” can do harm, it appears that reflective action deserves just as much a place at the performance table as does unreflective action. While the disability community has long argued convincingly that disability is not a negative condition, academic and popular discourses on environmental justice routinely refer to disability as a prima facie harm to be avoided. This perpetuates the harms of ableism, and it is, furthermore, unnecessary in order to advance environmental justice. It is possible to demand an investigation into the state of an environment, to object to toxic environmental conditions and to hold polluting parties accountable without assuming any overall difference (...) in value or desirability between disabled and non-disabled lives. I adapt an old example of Frank Jackson's, in order to show that it is not only possible that actions with different individual agents are sub-optimal when each is not, but that they are impermissible when each is not, and blameworthy when each is not.

This scenario-based study examines the perceptions of university students in the United States and Australia regarding the ethics and acceptability of various sales practices. Study results indicate several significant differences between U.S. and Australian university students regarding the perceptions of ethical and acceptable sales practices. These differences centered on company-salesperson and salesperson-customer relationships. The findings are significant for the employer, and have consequences for customers and competitors. They also have implications for recruiters and managers of salespeople, academics with an interest (...) in understanding cross-national differences in sales ethics, and educators preparing students for future careers as business professionals. Even with the very best intentions , Western culture’s approach to wilderness and wildness, the otherness of nature, tends to be one of imperialistic domination and appropriation. Nevertheless, in spite of Western culture’s attempt to gain total control over nature by imprisoning wildness in wilderness areas, which are meant to be merely controlled “simulations” of wildness, a real wildness, a real otherness, can still be found in wilderness reserves . This wildness can serve as the literal ground for the subversion (...) of the imperium, and consequently as the basis for the practical establishment of and residence in what WendeII Berry has called the “landscape of harmony.” Here all land becomes wild sacred space that humans consciously come to reinhabit. In this subversive potential lies the most fundamental justification for the legal establishment of wilderness reserves. (shrink)

Nietzsche is generally regarded as a severe critic of historical method and scholarship; this view has influenced much of contemporary discussions about the role and nature of historical scholarship. In this article I argue that this view is seriously mistaken . I do so by examining what he actually says about understanding history and historical method, as well as his relation to the founders of modern German historiography . I show, contrary to most expectations, that Nietzsche knew these historians well (...) and that he fundamentally affirmed their view of historical method. What he primarily objected to among his contemporaries was that historical scholarship was often regarded as a goal in itself, rather than as a means, and consequently that history was placed above philosophy. In fact, a historical approach was essential for Nietzsche’s whole understanding of philosophy, and his own philosophical project. (shrink)

Challenging the standard interpretation of Nietzsche's last published work, Ecce Homo, as frivolous autobiography, Thomas H. Brobjer provides an original and detailed analysis of Ecce Homo as fundamental to Nietzsche's unfinished masterwork on the revaluation of all values. Arguing that Ecce Homo laid the foundations for his planned four-volume work on values, Brobjer draws together the intentions and motivations behind Nietzsche's late work to create a new narrative on it. He situates this period in the desire to undermine the (...) system of Christian values that Nietzsche believed were unchecked as the standard moral gauge for his time. To engage in this project, Brobjer shows that it was essential for Nietzsche to explore the self and life-denying qualities of a Christian system of values within a broader framework of ideas about morality, altruism, egotism, pessimism, humility and pride. To do this, Nietzsche used an autobiographical text to define himself and his ideas as a precursor to a more comprehensive revaluation of values, of which only one volume would be completed and finished before his death. By fully outlining the context of Ecce Homo, Brobjer provides a complete corrective to its reception as a self-referential and eccentric text of little philosophical significance, enabling a new understanding within the history of philosophy and Nietzsche's oeuvre. Thomas Murray's graceful and humane book illuminates one of the most morally complex areas of everyday life: the relationship between parents and children. What do children mean to their parents, and how far do parental obligations go? What, from the beginning of life to its end, is the worth of a child? Ethicist Murray leaves the rarefied air of abstract moral philosophy in order to reflect on the moral perplexities of ordinary life and ordinary people. Observing that abstract moral (...) terms such as altruism and selfishness can be buried in the everyday doings of families, he maintains that ethical theory needs a richer description than it now has of the moral life of parents and children. How far should adults go in their quest for children? What options are available to women who do not want to bear a child now? Should couples be allowed to reject a child because of genetic disability or "wrong" gender? How can we weigh the competing claims of the genetic and the rearing parents to a particular child? _The Worth of a Child_ couples impressive learning with a conversational style. Only by getting down to cases, Murray insists, can we reach moral conclusions that are unsentimental, farsighted, and just. In an era of intense public and private acrimony about the place and meaning of "family values," his practical wisdom about extraordinary difficult moral issues offers compelling reading for both experienced and prospective parents, as well as for ethicists, social and behavioral scientists, and legal theorists. Nozick provides us with a compelling characterization of romantic love, but, as I argue, he under-describes the phenomenon, for he fails to distinguish it from attitudes that those who are not romantically involved may bear to each other. Frankfurt also offers a compelling characterization of love, but he is sceptical about its application to the case of romantic love. I argue that each account has the resources with which to complete the other. I consider a preliminary synthesis of the two (...) accounts, which I find wanting. The synthesis I then favour relies upon two thoughts: each romantic partner has loving concern for a plural object viz. the two of them, and romantic partners are, in addition, beloved of a plural subject, viz. the two of them. A corollary is that Frankfurt is wrong to think that, whilst self-love is a pure form of love, romantic love is an impure form of love, for romantic love just is a form of self-love. In an appendix, I defend the coherence of the thought that love can have plural relata. (shrink)

Trenton Merricks argues that the Incarnation gives us strong reasons to embrace physicalism. I argue that these reasons are not so strong, and that there are important questions remaining about both the coherence and the orthodoxy of physicalist Christology.

The consensus in the philosophical literature on joint action is that, sometimes at least, when agents intentionally jointly φ, this is explicable by their intending that they φ, for a period of time prior to their φ-ing. If this be granted, it poses a dilemma. For agents who so intend either severally or jointly intend that they φ. The first option is ruled out by two stipulations that we may consistently make: (i) that at least one of the agents non-akratically (...) believes that, all things considered, the agents ought not to φ, and (ii) that an agent is akratic, if she intends a thing that she believes, all things considered, ought not to be done. But the second option seems to entail the existence of a mental state with multiple subjects, which, in turn, seems to commit us to the existence of a group mind modified by that state: an incautious posit to say the least. I resolve the dilemma by noting that ‘They jointly intend’ is indeterminate between ‘They intend, jointly’, which does indeed entail that some mental state is an intention with multiple subjects, and ‘Jointly, they intend’, which entails a weaker claim, viz. that some mental state or states is an intention with multiple subjects. I then sketch an account of how a plurality of mental states, distributed among subjects, might, collectively, do service as their intention that they φ. It makes novel use of notions of participation and of doing a thing jointly with others. A corollary is that either intentions are not attitudes towards propositions, or propositions are individuated more finely than is often assumed. (shrink)
